A new ownership group is being sought to resume operations of Scenic Rush. All gift vouchers and deposits will be honoured. All voucher expiry dates after 2020 will be extended for 2 years beyond the reopening date. We thank you for your patience and understanding and apologize to everyone affected by the sudden closure of Scenic Rush by the Zerosa Group in July 2024.

The Scenic Rush brand was operated by the Zerosa Group from May 2022 until September 2024. Deposits paid to Scenic Rush during this period were transferred to accounts belonging to Zerosa Investment Corp.

The Founder and CEO of the Zerosa Group is Sukhpaul Sandhu. Other companies operated by the Zerosa Group include Zerosa Developments and Zerosa Luxury Car Rental. Claims by the Zerosa Group that it was "not involved with Scenic Rush" are false, as detailed below.

CURRENT STATUS UPDATE

The Scenic Rush brand has been reclaimed by Thom Boecker and Scenic Rush Driving Experiences Inc. due to a material breach of the brand licensing agreement, failure to provide services as well as various public statements and denials by Sukhpaul Sandhu and the Zerosa Group.

The Zerosa Group has been locked out of all Scenic Rush online accounts, except Instagram, which Sukhpaul refuses to return control of.

We appreciate your patience while we work to rebuild the brand and find a stable and trustworthy ownership group to continue future operations.

We also sincerely apologize to everyone who put their trust in the Scenic Rush brand for the events that occurred after July 19 (as outlined in the timeline below) as a result of decisions made by the Zerosa Group.

We will do better to find an ownership group that possesses a stable financial foundation and the business ethics that align with what Scenic Rush has always stood for, prior to the Zerosa era.

We understand that the details of the dispute between Scenic Rush and Zerosa means nothing to those who paid their hard-earned money towards an experience that hasn’t yet been fulfilled. However, we can not sit idly by while false information is put into the public realm. So we will continue to update this page with our response to false and misleading claims until a resolution is found that satisfies the customer base.

RESPONSE TO FALSE & MISLEADING STATEMENTS BY ZEROSA

Response to Online Reviews

Statements made by Sukhpaul Sandhu of the Zerosa Group in response to negative reviews online are false and misleading.

Statement by Zerosa: “We want to clarify that neither Zerosa Group nor its subsidiary, Zerosa Luxury Cars, has any operational control over Scenic Rush.”

MISLEADING - While true in the present sense, this is false as it relates to the period that the complainants are referring to. The Zerosa Group had FULL operational control over Scenic Rush from May 2022 until September 2024.

Statement by Zerosa: “While Zerosa Luxury Cars provided vehicles under a rental agreement to support Scenic Rush’s operations, Scenic Rush has not fulfilled its payment obligations, leaving a significant outstanding balance”

FALSE & MISLEADING - This is a clever strategy by Sukhpaul, but extremely misleading and malicious.

Scenic Rush Driving Experiences Inc. (Thom Boecker) does NOT owe the Zerosa Group (Sukhpaul Sandhu) money... period.

SIMPLE EXPLANATION:
One Zerosa company (the owner/operator of the Scenic Rush brand from May 2022 to September 2024) owes another Zerosa company (the owner of the vehicles) money on paper only.

DETAILED EXPLANATION:
1359805 BC Ltd (doing business as Scenic Rush from 2022 to 2024) would rightfully pay 1296471 BC Ltd (dba Zerosa Luxury Car Rental) and Zerosa Investment Corp. a “usage fee” for the vehicles that were used by Scenic Rush while the brand was owned and operated by the Zerosa Group.

All three of the companies listed above are owned by the Zerosa Group, so this would be an INTERNAL paper transaction within the group of companies. All funds paid from customers to Scenic Rush between May 2022 and September 2024 were transferred to Zerosa bank accounts. Assigning some of those transactions as “vehicle usage” would be at the discretion of Sukhpaul Sandhu and/or the Zerosa accountant.

Statement by Zerosa: “Zerosa Luxury Cars has no access to Scenic Rush’s communication channels, such as emails, phones, or their website.”

MISLEADING - Another misleading statement in the sense that while true now, it is completely irrelevant to the time period of the complaint. The Zerosa group had full and sole access to all of Scenic Rush’s communication channels from the time of Thom Boecker’s resignation on July 21, 2024 until they were locked out in September for material breaches of the licensing agreement.

It’s interesting to note that the list of communication channels does not include Instagram, which was transferred to a Zerosa email. Sukhpaul has failed to return control to Scenic Rush Driving Experiences Inc. despite several requests.

Statements made by Sukhpaul Sandhu to CTV News are categorically false. The Zerosa Group and Sukhpaul Sandhu was DIRECTLY involved in the operations and all important ownership-level decision making for Scenic Rush from May 2022 until September 2024.

All deposits paid to Scenic Rush for experiences and vouchers during that time were deposited to a bank account belonging to 1359805 BC Ltd (a company owned by the Zerosa Group). Aside from funds that were used for salaries and other Scenic Rush related expenses, the majority of the funds were ultimately transferred to the bank account of Zerosa Investment Corp.

Operations commence under the brand name Scenic Rush and continue to operate under the ownership of Scenic Rush Driving Experiences Inc.

APRIL 2020 to APRIL 2022

Scenic Rush is closed due to the COVID-19 pandemic. The pandemic has a devastating effect on the business.

As the COVID-19 pandemic is coming to an end and business are reopening in early 2022, Thom and Bryan start looking for an investor to help relaunch Scenic Rush.

After meeting with several prospects, there is too much uncertainty in the tourism and automotive industries to secure an investor in time for the 2022 season.

APRIL 2022

The Scenic Rush brand is licensed to the Zerosa Group, which operates a luxury and exotic rental car company, doing business as Zerosa Luxury Car Rental.

As part of the licensing agreement, the Zerosa Group agrees to honour all gift vouchers that were sold by Scenic Rush Driving Experiences Inc. between July 2014 and April 2022.

Thom becomes an employee of the Zerosa Group while Bryan exits the business completely.

1359805 BC Ltd is registered by the Zerosa Group for the operations of Scenic Rush.

MAY 2022 to AUGUST 2024

Scenic Rush Driving Experiences Inc. ceases control of the Scenic Rush brand, which resumes operations under control of 1359805 BC Ltd, under the umbrella of the Zerosa Group.

Thom manages the day-to-day operations of Scenic Rush, while Sukhpaul Sandhu, the Founder and CEO of the Zerosa Group, has the final authority on all major decisions.

Vehicles used for the operation of Scenic Rush are owned by 1296471 BC Ltd (dba Zerosa Luxury Car Rental) and/or Zerosa Investment Corp.

Revenue and deposits collected from 2022 to 2024 are transferred to accounts belonging to Zerosa Investment Corp.

2024

JULY 16 - Sukhpaul and Thom meet in person to discuss the business. Due to a strained relationship and other developing factors, they mutually agree that Thom will depart from the business at the end of the operating season. Sukhpaul advises that he has some “tough decisions to make” about the business.

JULY 19 - Sukhpaul abruptly notifies Thom that he will be picking up all vehicles from Scenic Rush. He arrives with a crew of family and friends on a Friday evening at 10:30 pm to take the vehicles. Thom is instructed to cancel tours that were scheduled for the upcoming weekend due to “maintenance issues”.

JULY 20 - Sukhpaul instructs Thom to cancel a large corporate event that was scheduled for July 25.

JULY 21 - Unwilling to lie to customers about the reasons for cancelling tours and upset about the recent sudden developments, Thom tenders his resignation from the Zerosa Group and Scenic Rush, effective immediately. [Name Removed], a partner in the Zerosa Group, is assigned to manage communications with Scenic Rush clients.

JULY 26 to 28 - Nine customers are informed that their upcoming experience is being postponed “due to unforeseen circumstances” and that “two of our vehicles were under maintenance that has taken much longer than anticipated to complete.” The email is signed by “Kenneth [Surname Removed]”, the name of a relative of [Name Removed] who is visiting from the Philippines at the time and who does not possess the English language writing capabilities demonstrated in the email. The writing style is consistent with [Name Removed].

JULY 29 to AUGUST 6 - After receiving many angry responses at the sudden cancellations and lack of transparency, customer emails and phone calls are completely ignored. Several customers with confirmed bookings are not contacted and show up for their scheduled experience only to find an empty parking lot.

AUGUST 7 - After being contacted by several angry customers through the business owner of the parking lot where Scenic Rush operated, Thom reaches out to [Name Removed] by text message to advise that contact information for Zerosa representatives has been posted at the Scenic Rush meeting location. [Name Removed] responds to advise that he is “no longer working for the company”

AUGUST 7 - Nine additional customers are informed that their upcoming experience postponed due to “unforeseen circumstances” and “challenges created” by the resignation of Thom. The email is again signed by “Kenneth [Surname Removed]”. The writing style is consistent with Sukhpaul.

AUGUST 8 - Thom issues a notice by email to Sukhpaul to not use his resignation as the reason for cancelled tours.

AUGUST 8 to SEPTEMBER 2 - Customer emails and phone calls are completely ignored again. Also during this time, payments are stopped for the Scenic Rush domain and the website becomes inactive.

AUGUST 15 - As customers start filing disputes with their credit card providers, the bank account information for 1359805 BC Ltd is deleted from Scenic Rush’s credit card processing service.

AUGUST 30 - CTV News releases a story about Scenic Rush, stating that Zerosa claims “they have nothing to do with Scenic Rush.”

SEPTEMBER 2 - Scenic Rush is removed from the Zerosa website, where it was previously listed as a Zerosa Automotive company.

SEPTEMBER 3-4 - A poorly worded email notifies five concerned customers that experiences are “most likely postponed till next year” and “the previous owner of the company left a mess for us.” The emails are unsigned.

SEPTEMBER 23 - CTV News releases a follow-up story in which Zerosa “said it stopped providing supercars to Scenic Rush as of June 2024” and “it can’t help with refunds.”

OCTOBER 23 - Scenic Rush Driving Experiences Inc. issues a legal notice to Sukhpaul Sandhu and Zerosa Investment Corp stating “Your company, Zerosa, and you personally as its directing mind, are responsible to ensure that the Deposits are accounted for and returned to the customers who paid them.” The notice requests the Sukhpaul “provide us with a reasonable plan for the return of the Deposits to customers”. No response is received from Sukhpaul by the November 8 deadline.
